Chase Bank Lawsuit
Update – June 23, 2009 :: It looks like Chase has notified additional customers that effective August 1 2009, their minimum monthly payment will increase from 2% to 5% of their outstanding balance.
However, it appears Chase has provided an opt-out option this time. Customers who choose to opt-out can avoid the increase in their minimum monthly payment, but their account will be closed. But in the end, that’s probably a good thing. The fewer customers Chase has, the less opportunity they have to victimize them.
Update – June 25, 2009 :: Some readers who posted comments below are stating that Chase is not providing an opt-out option this time. But, on this post over on Dr. Lahm’s website, he states an opt-out provision is being provided. Strange that some customers are being given the opportunity to opt-out and some are not.

Girard Gibbs LLP has filed a class action lawsuit on behalf of cardholders who accepted an offer from Chase to transfer their balances to a credit card with a low interest rate that was guaranteed for the duration of the loan.
Many of these cardholders (estimated to be as high as 500,000 people) have complained that they were recently assessed a new $10 monthly service charge and notified that their minimum monthly payments would increase from 2% to 5% of their oustanding balance.
Upon calling to complain about these developments, some cardholders state that Chase representatives offered to remove the monthly service fee and reduce the minimum payment to 2%, provided they agreed to a higher interest rate.

I have had a 3.99% FIXED rate on my Chase CC since 2004. My rates went to 14.99% in January without my knowledge and without due cause. I was not late and make more than a minimum payment each month. I called and was told the new terms were mailed to me. I stated I received them but nowhere was it stated my rate would quadruple. I was offered a 10.99%, but this is nowhere near what I had. The rate was the only reason I opened the card.

I also had a chase credit card
without any notice they raised my rate to ( around 2005 )
when I called and asked them why the gave me no reason

I used to WA Mutal credit card client. I got the low 1.99% transfer balance interest rate. I didn’t
received any letter from Chase mentioned that they transfer my account to them and increase my
interest rate from 1.99% to 17.99%. I paid on time each month and without paying late, so I called
to their customer services to complaint. The Supervior agree to give me 7.99% and will send the letter
to confirm. I got the confirm letter said my interest rate will be 7.99% until Jan 2011. However, when
I received my statement they still charge me 17.99%. I called them again. In the beginning, another
superviser said she will listen the record tape about the conversation between me and the previous
supervisor and called me back. When she called me back, she delined the preious supervised didn’t
promise me the interest rate and the confirm letter was send by mistake. I felt that they like as a
theft to use any methods to steal the money from the client

ive been told that if you return merchandise and your credit card was stolen the merchant will issue the credit to your old credit card number…I would think that a corporation like Chase that they would automatically move that over…I have been told that there have been old merchant credits that have never been moved over and Chase credit cards do nothing about it unless you call in and have it transferred to your replacement account…..customers should get some kind of rate for that……..Chase is an awful place to work for…my husband has told me that they tell their workers that if they dont do a better job in the states that they will lose their job and they will be outsourced…plus I have been told if they want a raise they need to quit their current position to lose benifits and apply again to get a pay increase…my husband never complains about his job, but ive seen his pay go down over $9000..I know that Chase will never compensate for that since my husband tells me that if you complain you should look for another job and it will be tough since we are in a recession. i have a mortgage with Chase and since they cut my husbands pay who works for chase…its been harder and harder to make to mortgage payments….I am really beginning to think that the banks need to work as a union and not think about their shareholders to help this economy…they cry that they want the economy to get better, but they need to help their employees and not try to intimidate my husband…if there is any kind of help please respond to my email xxxxx@xxxxxxxxx.xxx and I will give more info…my husband has told me that he cannot say anything in email about his job so I am writing this for him

I wish to join your lawsuit again chase. I am a teacher in NYC. My wife was sent an upgraded gold credit card to their original credit card because the original blue credit card looks exactly like her blue debit card. We find out later that the new card’s information did not get the old card’s automatic payments so my wife was charged 2 late fees of $45. Later I withdraw some money in the bank at the Forest Hills branch and they ask me to visit a representative and then tell me to upgrade my debit card to a better one with a $25 yearly fee. I said who the “fuck” are you to offer me an upgraded credit card like this. They suck your blood of money and I just don’t like them. Please let me know about your lawsuit and I will join you.

Looks like Chase is BACK at it again!! I have seen three sites today with consumers receiving minimum payment increases from 2% to 5% that goes into effect August 1st 2009!!

I wish to join your lawsuit against chase.
I received the notice from Chase credit card in the mail yesterday about the minimum payment going up from 2% to 5%. I have had my credit card since 1994, in good standing, never a missed payment nor was I ever late. I took advantage of balance transfer offers with their life-of-the-loan low interest rate offers of 2.99, 3.99 and I think 4.99. I used the card as debt consolidation & some pretty unexpected things came up wher a substantial amount of money needed to be paid immediatley.I placed a call to cust. service & spoke to a man who said there was absolutly nothing that could be done & that i should hire a financial adviser. He was cold, uncaring & uninterested that I have been a cust. for 15yrs with impecable payment history & credit. My payment will be jumping from $207/month to over $500 & they don\’t care??? I requested to speak to a supervisor & over & over this man would just tell me the supervisor will not tell you anything different than what I\’m tell
ing you. I told him I don\’t ccare I want to talk to them anyway & he replied I don\’t think I want to help you .. I have to admit that the kid in me came out & I stomped my feet & screamed \”I don\’t want to talk to you put a supervisor on the phone now\” when the super came on she said there was something that could be done & they have a department for that (something to do with hardship) when she finaly transfered me I spoke to a woman who told me that the only option I had if I could not pay the over $500/month payment was to close my account that I have had for 15yrs. & depending on your income & other bills(they ask a series of questions) they come up with a monthly amount @6% interest for 5 years. Now my payment will be $201/month instead of over 500. I am still angry .. but there is a solution .. something can be done so you don\’t ruin your credit..
Damage Resulting = If they had done nothing I would have to file bankruptcy & it is so unfair because In these times I have managed to keep my good credit. It took for me to hyperventilate & cry and loose all respect for my self for them to tell me that there is something that could be done. I am humiliated at the way that I was treated after 15 years.

Really appreciate your 6/23/09 update above ref. Chase Bank lawsuit. I too was hit with a 2 to 5% increase effective 8/1/09. Rece. notice yesterday with no opt. out/closing of acct. and staying at 2% mentioned and immediately went round and round with them via phone, getting nowhere. I did advise them to close my acct. immediately. Any source I can check ref. said opt.-out so I can relay over to Chase….Thanks. Really appreciate your time..cas…

I received the notice today, but I did not see any opt out. In fact when we called they said if you can’t pay it you have to go to the hard luck dept.

Just thought I’d post and say that I got the same letter, no opt out though. Not in the letter or when I called. They basically told me too bad for you, both the first person and the 2 supervisors I spoke to. I think the people who might no be able to afford to pay are getting the opt outs, while we, like some others, can afford the payment and are not. I already transferred the balance out, I have a good card with my own bank that will not be increasing the minimum payment on me, interest rate is higher, but the piece of mind will be worth it. As well as getting rid of Chase, it’s only a matter of time before these maggots go under and I can’t wait.

I received the notice about min pay change from 2% to 5% yesterday. No opt-out option given on the notice, so I called the number on the back of my card. Advisor was not able to help, stating no opt-out available. How can this be legal?

The legality of what Chase is doing is questionable and their actions are really in uncharted waters. No bank of this size that has ever received so much money from their customers (both in interest payments and taxpayer bailouts) has ever tried to pull something like this. I hope that in the end, several years from now, when the economic devastation is behind us that people remember how Chase treated them and they become the pariah of the financial industry. Frankly, this bank should have been allowed to fail and should have never received any money from our government – no bank should have. TO BIG TO FAIL is a ridiculous way to run things.

I think it is time to organize a “Boycott Chase” movement. We can ask folks to stop using the bank and stop accepting checks and credit cards from the bank. Some pickets in front of the branches would draw important attention

I got the notice today as well. NO OPT out allowance. Most likely because I have a 3.99% rate for life. They claim the only way to keep the 2% Minimum monthly payment is to have the rate raised and join a frick hardship program. I hope OBAMA reads this as they are blaiming him and the new credit card rules. (Not kidding)These crooks need to be jailed..not just sued..any lawyers want to represent me?? I am more than ready.

My wife had her hours cut. I took on a second job. We were proud that were working hard to keep our heads above water after medical bills almost sank us.
We moved a large balance to Chase for their touted “Lifetime Low Interest.” It helped.
We’ve never missed a payment, never been late and were making progress.
We have a 3 year old and are on a tight budget.
Our minimum payment just more than doubled. Instantly. We simply don’t have that money. We would have in a year or so as our hard work paid off, but we won’t now.
Everything has changed now. All of our hard work to make it through has been for nothing.
We can expect a huge hike in interest and fees as we can’t pay this, and of course, the other credit card we have will immediately hike our rates when this affects our credit.
It is almost as if they want tens of thousands of people to default or declare bankruptcy.
It’s disgusting that this is legal in our country. It feels like bait and switch.
It’s amazing that the people at the helm of Chase can’t see how this is going to further hurt our economy. Of course the hurt to their customers who took their low rate offer and have been paying a fixed amount on time for the last year is of no concern.
Chase did offer me an “out”. I could work with a Credit Agency the recommened for a debt payoff plan, and detroy the credit I worked so hard to keep. We wanted to buy a house when we made it through this.
I looked into this company Chase “works with and is legitimate!”
BBB revoked their membership, and complaints all over the web about them.
Working hard and trying to be a good guy, you really do finish last.

I am really sick of this bank. I just received my minimum increase too–due in August.
I’m thinking a class action will take forever and that’s just what Chase bank knows–so they can be as nasty as they wanna be—I don’t see them trying to keep good customers right now—they seem desperate and they’re reflecting this.
I was just kicking around some ideas that I will try looking into:
Years ago I had a problem with a rental issue and was able to pay my rent to the court while I litigated the problem–I’m sure Chase would would suffer quite a bit if thousands of people paid there money to their local courts for a while.
How about taking these guys to small claims court for misrepresentation—I did this one time with a really big satellite company (guess which one) because they put my signal through a tree in the winter and once the tree grew leaves I lost some of my channels–I won by default because the company ignored the court date–they eventually had to pay me to get there own boxes back–included a penalty too.(I was told that I could not do this with a big company because of ‘arbitrary?’ clauses–but I didn’t have that problem.)
Maybe we can find their company and meet with a massive protest to bring attention to the problem.
Are there any legal minds out there that know of other things that can be done then just waiting on a class action?

I too just got the notice, gave them a call and got the same BS about the hardship option from a special departmenr called the Pro-Active team…. Gee I was not in a hardship until they raised the pay back rate from 2% to 5%, which increase my payment from $400 to $1000. I have been a customer for well over 15 years and have never been late on a payment in fact paid off the card at one time and was hassled everyday with offers to take advantage of a low fixed rate if I transferred other cards to them. The guy that I spoke to told me that it was not Chase that wanted the changes that the government had been urging them to make these changes…. If that’s true, than all I can say is WTF are things not bad enough…. and if it’s not… Way to go with the creative blame shifting mr. customer service rep…. What a double kick in the balls they get bailed out with our money and they turn around a screw us all… Way to go Chase…. I will never forget how they treated me and make sure that I never do business with them again.

Just received payment increase letter and have not called yet but it sounds pointless. They are going to have to work with me though as there is no way I can afford the increase. I almost want to go bankrupt just stick these scumbags! This is a real shame I have NEVER had a late payment on any account and have very good credit. I will be in touch regarding the lawsuit.

If you look at the updates on changeinterms.com The opt-out was sent online and it was only for a couple of things, not the min payment increase.

We also got this increase. We were sent to the hardship dept after many circles around and around on the phone, final answer, No. We can either pay the 5% (not a possibility due to job loss and now underemployment), pay the full balance by August 1, or accept 21% interest with the 2% minimum payment.
We came up with a 4th answer. Despite all the work we have done for 7 years of paying off debt and living like paupers on cash only to get out of debt, we are filing bankruptcy the end of July.
At this point our credit is worth less than feeding and providing for our family. We are done. They will ruin our credit rating anyway so who cares at this point.

Don’t feel bad if you file bankruptcy. Think of your family as a business. You always need to do what is best for your business and if filing bankruptcy will cause you to end up with an improved financial situation in the end, then so be it! You’re absolutely correct in your thinking – feeding and providing for your family is far more important than anything else. Bankruptcy is just a financial tool you can utilize to manage your finances. Just Google, “Life After Bankruptcy” and you will find FAR MORE websites that speak to happy endings after bankruptcy instead of sad ones. Best of luck and forget about Chase, they’re a horrible company.

In order to get immediate credit, I opened a Chase checking account. That was two months ago and I deposited a $8,500 check from a client drawn on their Chase checking accont. All was well and I withdrew $5,000 that same day in cash and took it to my old bank. (BofA). The following month, I deposited another $8,500 check from the same client and got $500 cash for a net $8.000 deposit. That was om Monday. July 14th. That same day I sent my payments on my home, car and American Express knowing and feeling confident that I had plenty of funds in Chase and a substantial amount left over for other living expences just like anyone would feel.
Tuesday, I bought two tires to replace the bald ones that I had been trying to survive with during this downturn. Wednesday, I went to the grocery store and my debit on the Chase card was denied! Thus the nighmare began. Was I a victim of identy theft? Did the IRS garnish my account? Would my car payment check bounce and then my car get repossed? Would my house be forclosed on? Would American Epress cancel my card ? At 58 years-old I was in a full-blown, pure panic, almost-going-to-have-a-heart-attack melt down.

CHASE BANK IS RENEGING ON A LOW INTEREST LIFE OF THE LOAN GUARANTEE THEY MADE TO ENTICE ME INTO TRANSFERRING BALANCES FROM ANOTHER BANK. I WILL NOT PAY THE HIGHER RATES AND REQUEST THAT CHASE BE STOPPED FROM DOING THIS. JUDGING BY THE NUMBER OF COMPLAINTS ABOUT THEM THEY SHOULD BE SHUT DOWN AND THEIR DECISION MAKERS SENT TO JAIL.

I’ve had a credit card with Chase since 2001. I have had a fixed 7.9APR since than. That is 8 years. I get my July statemet and my APR has doubled to 14%. I call and ask them what has happened and they told me they can change the terms at anytime. They told me they sent me a letter notifying me of the changes and that I had an opt out option. I never got this letter and the guy in customer service told me I can cancel the card and keep my old rate; or keep my card active and have the rate double. I have an 8,000$ balance, why would I want my rate doubled? I chose to cancel my card, which they did, and they told me everything would be fixed and taken care of by the next statement. My next statement comes, nothing has changed. I call them again, get blind transfered around, spoke to representatives who were either rude and/or hung up on me and finally an idiot “supervisor” who told me theres nothing I can do. I got as many names and locations as possible. I would like to partake in any class action or general lawsuit against this practice. Theres no possible way this is allowed by the Truth and Lending Act. Having a FIXED APR for 8 years and than getting it doubled because “they can”? I would understand if this was a variable apr and I simply screwed up but chase is changing the terms of the original deal and this has to be against the law. How do I fight this?

I was promised a 9.99% fixed rate for the life of the loan and I have never paid late on any of my accounts with Chase or any other Loan company and always pay more then the minimum amounts and they still changed my rate to a flexible rate of 10.99% plus the Prime Rate. They stated the change was due to market conditions and increasing cost. They promised I could opt out so I call them and closed my account over the phone and the lady I talked to said my account has been closed but I have never received the confirmation letter stating my account has been closed. Please add me to your Lawsuit against Chase Bank.

I had chase increase my promotional payment rate from 2% to 5%. I did a balance transfer a while ago to take advantage of the great rate. Now they are saying that I they have every right to change the rate. I had to go back to the rate of 2% but I had to agree to the 7.99% apr, vs the 3.99%.
Something needs to be done about them!

It is clear that Chase is attempting to gauge the feelings of the American public in general and to justify its actions as “tough love”. I do not doubt for a minute that CNNMoney was put up to this, since the credit card industry pays a huge amount for advertising.

This is not about Chase credit cards but does anyone have a home loan with Chase where you pay the monthly bill via their website? I’ve noticed the past 4 months or so that even though I select a certain day for the payment to come out it takes about 8+ days after before it does? So does this mean they are charging me additional interest for the higher balance those days that they lag taking the payment out?

The same with my account. I took advantage of the fixed for life promotion that Chase offer to consolidate all my account (including my equity line). Now they increase the minimum payment from 2% to 5%, that makes the payment amount ridiculously high that it does not make sense. I am forced to quickly find away to move those debt out of Chase immediately. I hope that the lawsuit prevail on this case not necessary for recouping any damages but really more like to slap Chase’s face strong for what they did.

There are several options for the almost 1 million customers that Chase has screwed. First, contact Chase just so you can hear the “thats too bad” speech. Then file a complaint here

It will get Chase attention! Also file a complaint with your states Attorney General and Federal Attorney General. Chase can put some on hardship payments by closing your CC account and putting you on a type of loan that is low interest and low payment for 5 yrs. Not all will qualify.
This is what you get with a government controlled by corporate money. Like FDR said, a government by organized money is just as dangerous as a government by organized mob.

if the one million people who got backsided by these ass whipes sent the pre paid envelopes back to chase ,the ones that come in the mail it will cost them close to 1/2 million buh,they only have to pay postal fees if they are returned.

To whom it may concern:
RE: CHASE Credit Card # #### #### #### ####
I have been having a problem with my credit card since August of 2008; the reason for this problem is Chase stopped sending me monthly Credit Card statements.
As a result I was guessing as when to make a payment, as you can see by the enclosed spreadsheet.
I have called Chase customer service many times asking for statements, I was told the statements are on the way.
I never received a statement nor did the statements start arriving.
As you can see by the spreadsheet I have prepared I did a pretty good job at guessing as to when and how much money to send?
When this problem started to get out of hand your call centers were calling constantly, I asked for my statements many times with no help? I was also told Chase did not take pre payments; this is also part of the problem.
I Findlay received some of my statements from May, 2009 through October, 2009 and requested the balance,
The balance Arrived September 2008 through April 2009 in December 2009
Now that I have checked to see if the charges on my statements are mine I would like to fix the charges I incurred due to fact Chase did not send me statements as my many request’s for same were ignored, I did show good faith as you can see by the payments I made without monthly statements.
It is my intention to solve this issue with Chase however it seems your collectors are not trained to do so as I have failed up to now, I would appreciate your help as attorneys are costly.

Sadly, he’s not the first person to post sensitive personal information about themselves on my blog.
With all the stories about people’s identities getting stolen, you’d think people would be more cautious with sharing this type of information.
I guess you can’t save people from themselves.

3. Take some ownership in your life. Until then, don’t use your credit cards.

Chase is trying to force me out of my house with illegal means by trying to increase my monthly payments by defrauding me and informing me that I have not paid taxes since 2007. I have informed them about my payments with copies of check including large amount paid to them during closing of escrow. They have as of April 2010 started playing tricks by making payments on my taxes before I pay it. The Tax collectors office then after 60 days returns my check stating I have over paid. My taxes aree due date and they pay it before me. They have also by this process ruined my credit. Citizens need to boycott Chase Bank and withdraw all money from there and also urge their friends and employers.

I have a card that was 5.99% fix for life, period. I had this card since the 90′s I believe. Never late, no excuses. Just noticed they changed the rate to over 12%. Called and got nowhere. As far as I’m concerned…..I had a contract. When you get a fixed rate on an auto loan or mortgage….it doesn’t change because the bank is having a hard time. I’d like to direct this to the correct people.

I would like to be added this is the second time that they did this to me and is what I wrote to them:
I received a call two weeks ago in reference to my outstanding balance in my business account. I made a payment arrangement of $20.00 per week and they gave me until the end of September to pay off the balance. I am married with 5 children and this money was to be used for them.Now I was coming in on Monday to make my payment of $20.00 as pre-arranged. I do not understand why my money was taken out but I do expect the money in the amount of $228.90 to be returned to my account by the end of the day tomorrow Aug. 16th if the money is not in my account by tomorrow I will go to small Claims Court to file a claim against Chase. I was keeping my word with making the payment arangement so I don’t understand why Chase is not keeping theirs.

First they charged me $500 calling it late fees now they have started taking money from my saving in less than a month they took $50 ..im goin to have to close it out im tired of there crap and i dont know how they stay in business..
i sure would like to get my money back plus pain and suffering..
