Alright. Okay. I admit it. I went to Hell-Mart on Saturday. Forgive me, please.

Tina & I were spending the weekend cleaning the house and getting it ready for Fely’s return on Thursday and the Heathers’ visit next weekend. We needed a rug pad for a couple of the new area rugs we just had bought (at Target) and some 9V batteries for the smoke detectors. As we were up early at 7am and Target didn’t open until 8, we decided to just go to Hell-Mart for those two items and then stop at McSquirtie’s for breakfast. Our checkout experience was uneventful. But, there was nobody else in the store except us and maybe 3 or 4 unshowered bumpkins browsing near the video games. The store hadn’t changed much in the 3 months since I’ve been there. Still blue. Still dirty. Still full of employees who look like Roseanne Roseannadanna on a bad hair day.

I went home and showered.

Shopping and working at Wal-Mart is becoming more dangerous with every passing day. From the illegal demands to see proof of purchase to the nazi t-shirts to the Wal-Mart employee being sued by Wal-Mart for money she won in an injury lawsuit, Wal-Mart continues to be the place to avoid at all costs if you value your soul.

Now, a man who refused to submit to an illegal demand to show his receipt has been convicted of misdemeanor assault. Donald Lynch, a certified public accountant, says he will appeal the verdict. The story seems to go like this … A ancient Wal-Mart door ranger asked to see Lynch’s receipt. Rightfully so, Lynch refused. So, the door ranger used illegal physical force to stop Lynch from exiting the store. Lynch then retaliated with physical force in self defense during which the door ranger ended up on the floor. Anybody with half an eye could see that Lynch should not have even been charged with a crime. If anything, the Wal-Mart door ranger should be on trial for violating Lynch’s Fourth Amendment rights. And, Wal-Mart should have to pay a hefty fine for being the evil, evil corporation behind it all.

Did you know that it’s illegal for Wal-Mart to ask to see your receipt? Wait, how could that be illegal? They do it all the time!

At membership-only stores, like Sam’s Club, Costco or BJs, when you sign up for a membership, you’re agreeing to that store’s terms. Within those terms, they explicitly state that they may ask to see your receipt on your way out the door. And, as a condition of membership, you must oblige.

But, Wal-Mart isn’t a membership-only store. It’s open to the public. Anyone and everyone can shop there. Why anyone would actually want to is still just a mystery. But as such, you’re protected by the Fourth Amendment to the United States Constitution. Remember learning about that in elementary school … the Bill of Rights? So, what is the Fourth Amendment? The Fourth Amendment guards against unreasonable searches and seizures. It protects you from being illegally detained without reasonable suspicion that you have committed a crime.

Since Wal-Mart doesn’t require a membership to shop there, if they do not clearly and doubtlessly witness you shoplift, they cannot ask to see your receipt. If they only see you walking out the door with an item, but didn’t witness you take it off the shelf and bypass the cash registers, they cannot ask to see your receipt and they cannot detain you. Why? The presence of reasonable suspicion is missing. Simply watching you walk out the door isn’t sufficient reasonable suspicion. Therefore, they cannot legally ask to see your receipt and they certainly cannot stop you from leaving the store. After paying for your merchandise, your legal obligation to the store is complete and you are not required to submit to illegal requests to show proof of purchase on your way out the door.

T-Shirts imprinted with the 3rd SS Division Totenkopf death head from Nazi Germany made in a sweat shop in China. Where? Only at Wal-Mart. (Where else?) And, still for sale 50 weeks on after Congress asked Lee Scott (Wal-Mart’s CEO) to stop selling them.

On a related and somewhat ridiculous note, Wal-Mart sold to the disgusting t-shirts to Bealls Outlet stores instead of destroying them. Bealls Outlet put them up on the racks until a customer pointed out to them the same thing they had pointed out to Wal-Mart.
