Remember my rant from back in December about how f*cked up Chase Bank is for jacking up my minimum payment from 2% to 5% of the oustanding balance (a $600 increase) and assessing me a $10/mo service charge?
Well, I submitted my information to an attorney I found on Dr. Lahm’s website who is attempting to bring a class action law suit aganist Chase.
The attorney’s office called and I was asked if I’d be willing to be a class representative. Of course, I agreed. Now, my mind is filled with visions of me on the stand, telling the world the truth about the most evil bank in American history. I am euphoric. Will that really happen? Slim chance. But boy, I love to think about it!

Wouldn’t really worry about the responsibilities of being a class representative. It is simply that a class action complaint is captioned, “Party #1, Party #2, … N, and all others similarly situated…” and you’d be one of those named parties. Witnesses and plaintiffs are different things. The urgent thing these class action lawyers need is a named plaintiff who resides in California in order to use the California courts so as to get around the mandatory arbitration clause in the cardmember agreement, which California courts are most willing right now to set aside.

The most important thing that bloggers like you and me (and many others) can do is to bring this matter forward before the “court of public opinion.” If we do this, any legal proceeding has the best chance of success. We don’t deserve Chase, but Chase deserves those of us who are willing to fight until the day when the light of truth is shining brightly in its eyes.

I totally forget what Chase did to you. What happened? with all these banks buying each other out I dont know who my cards are under anymore. All I know is that in the last 2 months all my credit cards almost tripled their interest rates for my cards and lowered all my credit limits to whatever balance I have on the cards. This is without being late,ever, and always paying more than the minimum or paying off the card.

TD Banknorth was an amazing bank and when it took over Commerce I thought everything would be ok. What actually happened was they kept the TD name but in every other way they are Commerce. They screwed Mom’s account so bad and charged her over $800 in fees for things that were their fault. We dropped Commerce to go to TD why the hell would we want to go back again.

I found out why my WaMu account just changed interest rates to almost double what I had before? They are now Chase. Got the letter in the mail today that my wamu credit card is now owned by chase.

I am in a similar situation–I have written letters to: Rep. Barbara Lee, Gail Hillebrand (Senior Attorney, West Coast Office of Consumer Union), Ellen Futter (Member of the Board of Chase and Member of their “Public Responsibility” Committee), Chase Customer Relations (not expecting any concessions from Chase, and indeed, they called back and tried unsuccessfully to sweet talk my wife for 15 minutes, but without changing their position–we expected nothing but went through the motions with them). As much as their action hurts me and my family, I realize from reading stories on other websites how much more deeply others are being hurt by this action of Chase’s action. In addition to a lawsuit, I hope other mass actions can be organized eventually.

After a number of years of having a business cc through chase with a fixed 7.99
on both balance transfers and purchases (which I called yearly to validate and the most recent was last august they had said no problem) fortunately I had
read the little pamphlet they sent me in January, you know the one that is
so fine print with all the wording done in piglatin….
They were increasing my rate, and I had to make a decision to opt out by
2/20/09 or it would take effect. The supervisor said there was nothing she
could do. I had always paid over the required amount due and had not
even one late payment throughout the years….
They also have my bus. checking and I use them for cc services for my clients.
This really put me into a bind for my business because of the economic turndown, and talk about scaling back just to make a living….
Bottom line is I want to help bring this institution with fraudulent business practices to its knees. Any info about a class action suit would be gladly excepted.

I used to WA Mutal credit card client. I got the low 1.99% transfer balance interest rate. I didn’t received any letter from Chase mentioned that they transfer my account to them and increase my
interest rate from 1.99% to 17.99%. I paid on time each month and more money than the min balance and without paying late, so I called to their customer services to complaint. The Supervior agree to give me 7.99% and will send the letter to confirm. I got the confirm letter said my interest rate will be 7.99% until Jan 2011. However, when I received my statement they still charge me 17.99%. I called them again. In the beginning, another superviser said she will listened the record tape about the conversation between me and the previous supervisor and called me back. When she called me back, she delined the previous supervised promise me the interest rate and the confirm letter was send by mistake. I felt that Chase try to use any methods to steal the money from the clients.

We have a home loan with Chase and are trying to modify our loan. We have a list of complaints but the most interesting fact we just uncovered is that the parcel number listed on our Deed of Trust is for a parcel that doesn’t exist. i would love to take this bank to court for all the heart ache we have had to endure just to get a little assistance that I am sure they have received from the Government.
Any thoughts anyone?

I am having a problem with Chase Bank for their TJMax credit card. I opened a TJMax reawrd credit card back in December. Everything was going fine until oneday I didnot receive my monthly statement for April. well they submitted me one on april 30th for the month of May and they hit my with a late fee of 29.00. so I called their customer service center and spoken to a rep named Lisa. She was polite and told me that she would credited my account back the 29.00. She stated to me that I woulld see this credited to my account immediately. So I went on the pay 20.00 because my bill was then decreased to 17.00 minimum due. Now my new bill is in and their claiming that I owe 62.00 which makes no sense! So I called them and spoken to so jerk named Fidela who speaks broken english. Claims that the charges are correct and I only pay part of my bill last month. This is the break down: last month 46.00; 29.00 late fee plus 17.00 (regular due amount) now remember I was credited back the 29.00 and sent in a payment of 20.00. Now the new statemnet states I owe 26.00 from last month+29.00 late fee and 7.00. I am pissed off.

But, please remember that not receiving a statement is no excuse for not paying your bill. Sad, but true. Chase is allowed to use the excuse, “Oh, the post office must have lost your statement.” But, you’re not allowed to use the excuse, “The post office lost my payment.” With Chase, it’s a give-give relationship. And, it’s in the fine print that sending you a statement is a courtesy, not their obligation. Really, it’s up to you to record your charges, calculate your finance charges and remit the correct payment.
The best solution? Stop being a Chase customer.

I am closing my Chase account tomorrow after my last pending transaction is finalized. We opened an account with a different bank a while back. We have had numerous problems with Chase recently- and their customer service is terrible. We had a motorcycle loan that the interest rate doubled. We had a credit card that guaranteed “No interest, No payments” for 12 months and our first bill was not $0 like it was supposed to be (and they NEVER fixed that- it caused real problems for us). We have another line of credit attached to our bank account that the interest rate just doubled on in the past six months. They have given me faulty information that has not been to my benefit (put me in the negative!!) and when I complained about it, they told me there was NOTHING they could do for me, even though we had always banked with them, had credit with them, bought (and paid for) vehicles with them, etc… We have always done all of our business with them, and a payment that was not authorized to come through went through, overdrafting the account while we were in the process of switching banks (it was changed to the other bank account, with confirmation of change and everything), but for whatever reason, it was still charged to the Chase bank account, resulting in 10 (yes 10) overdraft charges on $3-5 amounts. So you know what they did, they said they would do me a goodwill favor and refunded one fee. If they would have just sent the small charges through first (they all went through the same night), then there would have only been one fee and I would have said, forget it, we’re switching anyway, and eaten the cost. Instead, I had to fork over $350 in fees in order to close the account (which goes through at midnight tonight). In the meantime, we have all of our July bills coming in the mail, 2 children, and minimal money that is accessible without penalties. They are crooked. I showed the account print-out of what happened to our new bank and the manager laughed and then apologized saying that they would never let one transaction cause so many problems in one night. Gee, wish I would have already been at the other bank!! I found this forum/blog because I wanted to find a class action attorney in San Antonio, Tx. I know if I hate Chase this much, then surely other consumers hate Chase too. Good luck with everything

I, and my daughter, have both received the notices of minimum payment increase from 2 to 5% August 1st. We reside in Arizona and are among the fortunate minority to still have jobs this year. Is anyone pursuing a class action suit on this latest round of arbritrary actions against customers who have always honored the terms of their cc agreements when they were originally accepted? Can we refuse to make the higher payments without risk of their inflicting a cascade of interest rate hikes, fees, etc, and without harming our credit scores? We have all taken pay cuts this year and Chase is pushing us to the brink of bankruptcy. We have several accounts with them due to mergers/acquisitions over the years and we genuinely fear that more notices will be coming in the mail. Thank you for any advice.

Here’s another problem with Chase Bank — I deposited $200 CASH to my account. Because Chase was already holding $925 for a WEEK to make sure the check that was deposited cleared (what’s up with that in today’s electronic banking?), I specifically told the cashier I was making a cash deposit and needed it available immediately. My brother across the country needed to draw some funds from an ATM there from this account.
She smiled, said ’sure’, then handed me my receipt. This is Saturday at 11 a.m., bank closes at 1 pm. At 3:00 I get a call from my brother — there’s no money in the account. I check the internet — sure enough, they’ve put a HOLD on my CASH DEPOSIT.
I call the 800 number and get to a supervisor who tells me this is absolutely something that has to be handled by the specific branch where I turned over my money. Corporate offices can’t help me. No options. Period, end of sentence. Branch is, of course, now closed for the weekend. God forbid the branch should burn down this weekend — I’ll never get my cash back, because nobody in the entire Chase empire can “fix” this (ha-ha) mistake.
So last night I’m complaining to my friends about and what do I find out? They’ve had the same experience of depositing cash and having Chase put a hold on it.
Isn’t this illegal?

I am a small business owner who has been dealing with Chase for years. I’ve always been a loyal customer and enjoyed dealing with them. However, in the last few months, things have changed dramatically.
They are stealing money from my business account. I have documented proof and have confronted them numerous times over this and their response is : “our website is different from yours and therefore we process our accounts on a different timeframe”; or, “The NSF fees don’t show up for one to two days”.
Which is ironic since every other transaction ever done, ie: debit cards, checks, deposits, etc, are done in real time.
Here’s how they are stealing from me: When I leave my business at 6pm, my account shows a balance of $ 500.00. I deposit on the way home cash for $200.00 and know that I’ll have $300.00 in secure credit card transactions scheduled for deposit overnight. This should give me a total of at least $ 800.00 since the $ 200.00 was after business hours.
If I have three checks come due during the night, the first for $ 525.00, the second for $ 100.00, the third for $ 75.00, Chase bank will take all three checks out of the account, charging me for three NSF fees and THEN deposit the credit cards for $300.00.
What they are doing is taking all debits out of the account BEFORE depositing any credits so that they can implement NSF fees.
To prove my point, I had copies made of my business account each morning and evening over a period of days and it clearly shows the cash flow and how they are charging the NSF fees for their own gain, not because of bad or misplaced funds on my part.
When I last confronted them, they basically said that there is nothing they will do and that I am waving false documents around, trying to scare up some funds.

You can add another major unfair practice to all of this.
I’ve been in the collection business for 12 years with another major
company. Right now, 1000’s of people, at least in Arizona that
are behind on their Chase Visa bill are getting calls from the
chase call center dialers, out of federal calling guideline regulations.(8am to 9pm)
On my caller I.D. in the last 3 days, I have Chase calling me at 7:01am, 7:11am and 7:13am. I also have gotten many more over the last 3 weeks which have
dropped off my caller I.D., but phone records can be pulled if needed for legal reasons.
This is Harrassment, their dialer is programed wrong and is breaking
a federal law every day. I want to start a Class Action for this on top of yours.
This is easily a valid suit. What are your thought.

Shame on you for canceling our cards without prior notice, but we expected no more from an impersonal, despicable big bank’s takeover of our nice, small town type bank we found in Washington Mutual. We’ve been expecting and waiting for something like this low-life action. And as to the lack of notice, what if we’d been in a position to need the card yesterday?! I found out by trying to set up a computer software trial when the card wouldn’t go through. And as if you cared, what if we were traveling, depending on this card for food, hotel and other services? What’s next, our checking accounts? In spite of our good management, it wouldn’t surprise us at all. I doubt any of you bank monsters have any concerns for individuals, so we’ll manage without your stinking credit cards. We were loyal customers of WAMU but not you high rollers. You are part of what’s wrong with this country. You are bums, a disservice to this country and we’d like you out of our state.
What part of “don’t use any more credit than you have to” don’t you understand? And, what part of paying off your credit card each month instead of letting your abysmal interest pile up money for you don’t you understand. It’s Chase vs their customers except for the high rollers.
And as far as sticking your nose into our credit reports, that is a tactic more recently being used by you impersonal machines to use against and inconvenience us. The one item on our credit report is a human condition, are disputing this and believe it to be the unjust charge we are going to prevail on, but again your impersonal nazi-style actions prevail.
And what happened to the nice MC who does your commercials? More crap of course from a company whose record is already exactly that…crap. It’s YOUR record that is found lacking. Have you bothered to see the long list of complaints on the internet? Like a Bank of America founder’s granddaughter is disgusted with what her bank has become, so it goes with you, but doubt you’ve ever been anything but another self-serving financial institution who doesn’t deserve decent people’s business.
And you think this is over? We’re going to put the word out about how you too are one of the bad guys. I’m thinking we should be able to make an indelible impression of what most Americans today suspect is the case. Your and your lot should be run out of business. I too had a Washingtom Mutual cc which was absorbed by Chase. My story is in May 8, 09 I paid the entire balance on my statement and sent a letter to Chase to close the account. On May 13, 09 I recieved a letter from Chase that acknowled the reciept of my letter. Additionally On june 29th I paid off the last of the “periodic daily balance” another issue to watch closely, and again requested that the account be closed since my contractual obligation was fufilled by paying off my entire balance. On Monday July 20th I recieved another letter from Chase stating that After careful consideration they decided to close my account for several reasons that will have a negative hit on my credit report.
I had at the same time paid off all of my credit cards and closed all but one of my accounts. All of my accounts except Chase sent letters acknowledging my request to close my accounts and make the proper notification to the credit reporting agencies.
I placed a call to Chase Custmer service Today July 22nd to find out if this letter had been sent in error. The Chase rep actually told me that my request to close my account had been denied. I couldn’t believe what I was being told. I am simply shocked that big bad Chase can actually deny m request to close my account since my contractual obligation has bee satisfied by paying off all monies owed. I feel I am being penalized because I did not want to continue to pay unbelievable interest rates to Chase for the next however many years. I honestly feel taht had I not paid off the balance and continued to make payments that Chase would have been ok with that.

When I called them to tell them I never asked to close my account, the lied to me…then backpedaled when I asked them to review the recorded conversation. When they knew they were caught, they tried to kiss my ass. Screw Chase…I’d love to see them go the way of Lehman Bros.

I realize that this isn’t the specific problem, but it is a problem with Chase.
Yesterday afternoon, I went to buy gas with my Chase card. I have a card with a $2,200 credit limit and I had about 500 left on my balance. When I presented the card, they said it was declined. I called Chase and the woman told me that my card was closed on July 22nd for reasons that will be disclosed in a letter. When I asked for further details, she kept referring for me to wait for the letter.
I haven’t missed a payment, not even one day late, why are they allowed to get away with things like this? My friend had her Credit limit cut from $10,880 to $3,600 because the balance on her other cards were going up too quickly. The reason they did was because she transferred the balance from Chase to other cards because Chase didn’t honor the interest rate she had with WAMU.
This arbitrary decision making is just bad business. They are alienating the people who are making their payments on time and if there’s a way to get involved in a class action, sign me up. Thank you.

Sent an email to Gordon Smith at Chase, got a call from ELIZABETH NOWAK in their executive offices. Phone 888-622-7547 x7185. She claimed that my credit line was dropped way down due to reporting from the credit bureaus that I had high balances with other cards. (This wasn’t a new development!) I let her know that Chase dropping my limit would hurt my 750 FICO, and that I’ve never missed a payment, never late, barely ever carried a balance with Chase (currently owe them $95). Elizabeth gave me the runaround and refused to restore my credit limit. I am moving all my money out of Chase (all my business/personal checking). I suggest EVERYONE ditches Chase. Let them feel the pain. I’m furious that my tax dollars bailed out these crooks and now after working my butt off to build a great FICO, they can hurt it with one stupid decision. COUNT ME IN FOR A CLASS ACTION LAWSUIT.

I just received a letter from Chase saying that they closed my CC because according to my credit report my balances are too high. Nevermind the fact that my payments are on time and I always pay over the minimum.
I’ve been with WAMU for 10 years. My credit card was with WAMU originally. Since Chase took the card over my interest has jumped up to 28.9%!! I had three cards jump up when I had gotten a card to use for my dental work. I filled it up so my rating dropped. Two cards agreed to lower my rate but Chase said, “Our hands are tied. There’s nothing we can do.” It has been my plan to get them paid off as quickly as I can but because of this insane interest rate I’m basically unable to make headway.
Last week I went to get gas and my card was denied (because they closed it). I am getting a settlement soon which will allow me to pay off all my debt but until then I need my credit cards to survive. My Chase card was the only one with room enough for me to get gas and food for me and my son. I have no idea what I’m going to do between now and then but at least I know there is an end to my relationship with this cruddy bank. I will be closing my bank account with them this week.
I don’t even want to know what this will do to my credit rating. It seems really unfair that they treat me this way and that I’m going to get punished. It’s not like I asked to have the injury that caused me to accrue the temporary debt. Talk about being kicked when you’re down.

Send the word out to boycott all Chase bank, all Chase bank products or services, and especially their credit cards. I know they’re screwing everyone because of Obama’s new rules coming January 2010 on credit card companies. Regardless, Chase is behaving the worst in this situation and my hopes is that all or most Chase customers close their accounts, payoff credit cards or balance transfer them to another bank, any bank. My wish is to see Chase/JPMorgan go out of business like other banks have. I use to think Citi Bank was bad, but Chase takes the cake and history will show what demons they are. Chase has opened bank branches in the west coast and I request to all to spread the word and boycott this bank. We the people can make a difference and show these greedy bankers who really has the power. Lastly, use your local Credit Union for banking and credit card services.

They are insane and just kicked me out of my own bank under the threat of assualt from a large man in a vest after i enquired about my overdraft fees.

I would advise that no one uses Chase Bank. They have so much non-value added waste in their processes it is no wonder they needed government money (and they are still making a profit). The majority of their CSR’s have no idea what they are talking about and I have spent hours being bounced back and forth from the same two departments (neither that I needed or requested). At any rate, I have taken my banking elsewhere and suggest everyone does the same.

Ever since the switch from Wamu to chase my bank account is screwed up! Even the tellers at my locat brance agree that holding a payroll check for a WEEK is ridiculous. However, they say the computer determines when it is available at the time of depost. They cannot even overide charges on a discretionary basis any longer. Debits are not taken out immediately, even if made at the banks ATM. This leaves a TRUE balance in the account. Deposits are not credited right away either if in check form. Instead they will hold debits, list them all as “pending” until it suits them it seems. Sometimes a day, sometimes 2 or 3 days. Then they process charges from largest (first), to smallest (last) (regardless of the day, or time of day the debits occur) to ensure they can NSF as many items as possible. Even ACH deposits made from the Attorney General are not “available” until the next day, and overnight they will NSF anything presented even though they have the funds. Class action suit is necessary. They are crooks and as always, it’s the little guys who get shafted. I am pissed! If I had the money I would personally go after them, just on principle. Cheating B@$$ards!

I lived in NJ, but would love to participate in any type of Law suit against Chase…I have been trying to modify my mortgage for the past 9 months with Chase. They keep loosing my paperwork, asking me to resubmit documents that I have submitted 3 and 4 times….Chase is not helping homeowner keep their home…all they are doing is getting funds from the Gov and pretend that they are trying to help. Please count me in for the class action suit. Chase Bank has robbed me for over a $100 in the past 30 days. Same things have been happening to me. All transactions except the ones that conveniently overdraft my account are in real time. I have receipts to prove it too. In fact they just took $35 of my paycheck for a 55cent overdraft that I paid cash to cover the same day. They are refusing to refund the fees to me stating they have refunding enough to me over the past year. Hogwash though! The fees are from their mistakes and delays in posting funds.
Another time I was out of work for a month and had $1.32 in my account just sitting there for 3weeks & then I needed a few things so I asked my dad who has a copy of my card to put $20 in the bank for me. He deposited the cash in one chase atm & I withdrew it from another chase atm. Interestingly my same day withdraw did not post till the next day …..using chase atm’s. I later found out about 5days later that within the couple hours the $20 was in my account I got hit with a $6 service fee for not using my card enough and didn’t have direct deposit at my new job set up yet. Grrrr!
After I took out the $20, I think 2 days later or so I deposited a $10 check. The chase atm said I had a bit over $5 in my account afterward so I figured they were holding part of my measly check. I ran my debit card immediately after leaving the atm at the grocery store for @$4. Should be ok right? Wrong! Like I said a few days later I was suddenly overdrafted twice from the stupid $6 fee. Then while I was disputing it with the bank & “customer service” they hit me with another “$12.50 extended overdraft fee.” So all in all, in 30 days that’s 3 overdrafts that should not have been, a $6 service fee, and the $12.50 extended fee. I would love to sue Chase & get my money back.

It’s amazing how many people have different horror stories about Chase. But, I’d like to remind everyone that these class action lawsuits are focused primarily on Chase credit card customers who took advantage of low and fixed balance transfer rates only to have Chase both start assessing a $10 service charge each month and increase the minimum monthly payment to 5% of the outstanding balance.

Someone please initiate this class action lawsuit. Since my bank Wamu was aquired by chase a few months ago, I have been hit with over $800 in overdraft fee. Just this week, I made a cash deposit into my checking account on 10/13, and Chase did not post my deposit until 10/14. There were 3 transactions that settled for 10/13 that caused my acccount to go into overdraft because they did not post my deposit until the next day. Of course I did not see an overdraft balance until I checked my account on 10/15, because I wanted to issue a check and I updated my check register for items that cleared and saw that I was hit with a overdraft fee of $105.00. I immediately called Chase to complain and challenge them because I have my deposit receipt which shows the date and time of my deposit. So I ran to the bank on 10/15 to make another deposit to cover the overdraft fees, and on 10/17 I check my account balance, to update my check register, and I have been hit with another $105 in fees for items on 10/14. You see, they unpost and repost transactions to maximize the potential for overdrafts. So they hit me with the $105 fee on 10/14, and then hit me with another $105 fee on 10/15 because the fee caused my account to go into overdraft. That is stealing, the bank fees are earned based on the bank being out of pocket, or having to cover insufficient funds on a customer account. But the bank has not suffered or earned fees, if the account was not overdrawn because a) the cash was deposited into the a/c and available to the bank, b) the overdraft charges were posted as a result of bank error, so the bank was never out of pocket to begin with, c) additional overdraft fees are incurred as a result of the overdraft fees that were erroneously charged to begin with, but the account was never cash deficient, only as a result of reposting transactions (a fictional depiction of what may have occured, but didn’t). I am calling my attorney because I have had it with this bank STEALING my money!

All I can say is that I was a loyal.., GW… to Washongtin Mutal customer since 91. They were the best! I would have never changed banks. But with my new issues and reading about those here… My whole family will change banks! I was caught in an OD nightmare… The way the can make it snowball! I one bounced like 13 transactions because of their decision to take out my mortgagepayment before debuting the other 12 ” realtime” transactions. WAMU’x policy was always that they took auto pays at 11:59 pm the day of. Nice to have but they changed that when Chase took over…, but didn’t tell me. They had taken it out @ 12:01 am.. And thinking I had tw grand in the bank until I deposited my husbands paycheck.. I did my shopping.., using my debit card 12 times! I had 2000 overdraft protection ( I guess that is the one thing they carried over) soooo… Nothing was denied! And the overdraft charges were over 400. The woman at my branch told me that I should make sir how much money I have in the bank before I go all crazy running my card. Even though I have been banking that way for years and years. She told me that it was irresponsible for spending that Money when I knew that my mortgage was due that day! Unbelievabe… They are getting the bailouts and we can’t make ends meet! This board has convinced me once and for all… As much as a pain it is to change … We are out! And my family ( grandparents) have A lot of money that they will be moving tbe hell out!

I have had several banks in my life, and have been fairly satisfied. I switched to Chase a few years ago because my mortgage was with them. I have come to realize that Chase is the most unethical and corrupt bank out there. They are thieves and preying on people especially in this difficult economy. Last week I was out of town and used my debit card at a cafe at the hotel we were staying at. My account was low but I was getting paid in a couple days and have direct deposit. I had more than enough to cover the two small debits at the cafe. I knew this for sure because the cafe had a computer for customers to use so I checked my balance. There were no other pending transactions other than the two small transactions at the cafe I had put through. When I got home that evening, I checked my online banking again and noticed that there was another transaction pending from later in the day from the toll authority. Apparently my transponder on my car was low on tolls so the toll authority put through an automatic debit without any warning. My account did not have enough in it that day to cover the toll authority debit so I knew I would be charged one fee. The toll authority charge was listed after the two small cafe debits so the toll charge was the last debit of the day and the only one that would have caused an overdraft. I accepted the one fee and had no problem paying it. But after my payroll check was direct deposited, I noticed Chase had charged me 3 overdraft fees for a total of $105.00. I looked again at my online banking account and noticed that Chase had rearranged the order of the debits and put the toll authority debit before the two small cafe debits. This switch in order gave Chase the opportunity to hit me with 3 fees instead of the one. I was furious and I called their customer service department. I told them that I knew they had rearranged the sequence of the debits which maximized their fees against me and they ADMITTED TO IT. They said they can arrange them however they choose without regard for the order the debits actually came through. I could not believe what I was hearing. I asked to speak to her supervisor and was told the same thing, that basically they can do this, it is not illegal and to bad so sad. I am closing my account and moving to another bank next weekend when I get my next paycheck. The new bank I called, which is actually a bank I used a few years ago, asked me what bank I was leaving. I told them Chase and she laughed and said they have tons of exChase customers coming over. Do not use Chase, they are thieves. I am also writing my state government to find out if what Chase is doing is legal and if so why! The greed of this bank is unbelievable.

Chase sent me convenience checks to in order to encourage me to tranfer balances. I paid another card with them–a week later chase sends me a letter telling me the check is declined because they are retroactively lowering my credit limit to almost nothing. Now not only am I not able to use the convenience checks chase sent me and encouraged me to use, but I am being charged a return check fee from my other credit card. A class action is warranted.

This is a follow-up to my previous comment above. After doing some checking and listening to comments from others, I am moving my account to a credit union, not a bank. I found one in my area. My son used a credit union out west as they are pretty popular out the in Vancouver, WA area and he said it was great. He loved it and said they were very forgiving on fees and their customer service was great. They were not out to screw people as we have found with Chase and the other big major banks.

I did not realize that I overdrew due to many items were purchased using credit and all the transactions went through on Monday after the weekend. I checked on a Saturday and only checked my account availability to see how much I can spend. On Tuesday when I checked my account I saw that I have overdrawn and that the charges I purchased were listed from most expensive of 40 dollars to the least which was 88 cents. I replaced the money immediately and saw that I was not charged an overdraft fee for going over. I was charged 198 dollars fees after I replaced the money from my savings and did not realize it until I checked my account that Thursday. I believed that I had money in my account and and began using my card again. Which led me to overdraw again after writing my rent check. I was charged another 99 dollars in fees. I have 0 dollars in my checking now and 19 dollars in my savings. I tried calling on the phone which I was hung up on twice and finally when I talked to a manager, she was completely rude and did not help out what soever. I went inside to the branch and told them what happened and again the manager was completely rude to my face and did not even try to get the fees removed. Not once did she call anybody, yet she gave me a life story about how I should better manage my account. I would not be in this situation if the merge did not happen with WaMu. I am a college student that is fully supporting myself with no help from any one else financially. Chase just robbed 300 dollars from me and now there is no way I can pay next months rent and bills and now left with only 19 dollars to my name. Thank you chase for being the best bank out there

Well I think we all agree we hate chase. I would like to know if there is a class action suit against chase for the dishonest overdraft practices? They hold charges up to a week, they will clear thing in random order in order to cause overdrafts, so they can pop you for 34.00 at a time. Has anyone else had this problem. Of course I don’t know there exact methods for clearing charges, but they will clear things and wait to clear others (debit charges not credit charges) untill the day before our direct deposit goes into our account. They will post charges that are pending on our register and then take them off not cleared but post them a week later. What???? If I have a case I would be more than happy to sue Chase for whatever I can get. Let’s just say my account will be closed by the end of the week.

Melissa, As far as I know, there are no class actions for overdraft charges. And, you may flame me for this, but 99% of overdrafts are the fault of the customer, not the bank. Really, it doesn’t matter what order the bank debits your transactions in. If you have a $100 balance in your account and you make 5 debits that total $110, you overdrew your account. The simple and responsible solution would be to keep a check register and know exactly how much you have in your account. I do not even know where to start. It is the day before Thanksgving and I am full of saddness. I knew I was going to over draft my account for $150 and knew I would get a fee of $35 because of this. I stopped using my debit last week and montitored my account daily. Everything had gone threw. Today before work I get online to see if that check had posted yet and bam. $600 overdrawn. They pulled transactions that were already listed on my account Sat night and moved them once my account was overdrawn. 9 overdraft fees…I cannot believe this. I am trying to move..(our stable financial lives crashed in 07 when our 2 year old was diagnosed with cancer)..I have a ton of bills and this really put me on the breaking point. I am an American…I have Rights and they basically robbed me. Those transactions had already posted!!! I am so..lost and so..hurt by this bank. I have so.much to be thankful for this Thanksgiving and now I have to be depressed and worry about this all day. THANK YOU CHASE!!!!!!!! any suggestions?? Have a Joyful Thanksgiving.

So sorry to hear about your child’s misfortune. As a parent, I can totally relate, And, sorry to hear about your 9 overdraft fees. $315 just in fees. Ouch! It is true … most banks can and will rearrange your pending transaction in such a way as to maximize the amount of NSF fees they can charge you. This is not unique just to Chase, it is industry wide. I certainly don’t agree with the practice. Transactions should post in the order the bank receives them in, period. That is the most fair & equitable way of doing it. But, you said you knew you were going to overdraw your account. Right there, red flags should have been going off in your head – something is wrong with your finances and you need to get them back under control. Everything is tight right now, believe me, I know – everyone needs to make that dollar go as far as possible and sometimes, you just don’t have the money for everything you need. But, at the end of the day, if you don’t spend more than you have in your account, you’ll never get charged an NSF fee, ever. A thoughtful, well worded letter to Chase’s corporate offices might net you a refund of some of the fees. And, if you know you’re going to continue to overdraw your account, I suggest looking for a credit union in your area and switching to them. Usually, credit union fees are significantly lower than a bank, but not always – so check the credit union’s schedule of fees before making any switch.

2 accounts, one was “overdraft ” 315.00. chase took from one acct to the other “withdrawal transaction to another account”
not same name, and i was not notified. they just did, cause they can.
to the bank , i was informed that they did not need auth since i was the generator.
if i had not checked the acct, I would have incurred more overdraft charges.

Why did they raise your payment so high? 29% is the default rate, which means they believe you paid them late. Did you pay them on time or did you pay them late?

I am having similar problems with Chase. Opened an acct with WAMU 15 yrs. ago. I loved WAMU, they were truly “customer friendly”. When Chase took over they promised things would not change…….what a huge corporate lie! They have made debits from my acct for debts I didn’t even know I had. They made these withdrawls on a whim, never notifying me of their intent, causing numerous overdraft fees. It seems that they waited until my balance got low and then made the withdrawl as though it was intentional just to be able to charge the fees. They have been ordered to limit the number of fees charged per day, I believe to 4 per day yet I have been charged as many as 8 per day. They have paid items then gone back several days and cut the item back once my acct was overdrawn again just to collect the fees. I have experienced many unauthorized debits from my account and experienced so many fees that as of today am closing my account and moving on. If any one is able to find an attorney to take a class action please post it….I’m in. Chase bank has unethical, dishonest practices and clearly is only in it for the $$$$. Most companies know in order to be successful they must have happy customers and be fair and profitable. I pray for the demise of Chase Bank!

I am having an issue with Chase, too. We had the change in terms issue on our cards. But, as former WAMU customers, we have to bank with them. Trying to find a bank I like to move. They have been holding our debits as pending until it gets to the point that something overdrafts our account (yes our fault). However, instead of confirming in the order they pended, they are re-ordering them to get the most overdrafts by putting the largest payment first, in this case, one that came in 3 business days than some of the others and causing those smaller amounts overdraft charges. We should have had 1 OD charge, instead we got 7 @ $35.00 each. I’d rather that one payment be returned and I deal with the return check issues than pay Chase $210. This has happen at least twice since the takeover and I think it happened in the summer to, costing us $480, that time, but I didn’t catch on to what they did. Yes, our fault for not realizing we spent too much, but, they are capatizling on it. Of course, they refuse to do anything. Their argument was that they order large to small to make sure the important stuff will get paid. Well, hello, you paying it all anyway, that’s not why you did that!

I am just outraged at Chase’s deceitful and unscrupulous ways they get money out of the middle class by slapping your acct with these absurd NSF fees! I am currently dealing with two issuse with Chase Bank. 1) Lastnight I checked my account before going to bed and it had several pending transactions that were scheduled to clear after midnight putting my acct in the negative by $2 so I transferred money to cover the difference and brought my acct to a positive. Tomy disgust, when I checked my acct at 5:38am this morning a personal check that I had written over eight days ago had popped up in my acct during the night and Chase had the audacity to post it first before posting the already present pending transactions of which I already had enough money in my acct to cover. This foolish action on their part took my balance to a dreadful neg after which Chase hit me with a $35 NSF fee per each pending transaction! All together, these NSF fees totaled a big-whopping $210 for greedy Chase!! These fees plus the check has of course put my acct in the negative by close to $800 and climbing!! Enraged, I tele’d Chase when their lines opened this morning and complained about the exorbitant NSF fees that had wrecked my acct due to the check which suddnely showed up and appeared in my acct during the night! I also asked the Representative why Chase would post that huge check during the night and neglect posting the current pending transactions which had been showing in my acct for the last couple of days? I told her that this would have lessened the drastic NSF fees that hit in my acct. The Chase representative replied that she understood my reasoning but that it’s Chase’s policy to post the larger dollar amounts first irregardless to when they show up in my acct bec the larger amounts are usually mortgage checks, car payments, etc.”. I then told her, that it’s not Chase’s prerogative to decide what should be paid first from people’s accts but that it makes more sense to pay items as they show up in the acct. I further told her that the said check was a payment for neither of those categories but was a 1x payment I had made almost eight days ago to a hotel. I told her that bec Chase had chosen to give this check priority posting it caused the other pending transactions which were way smaller than the check, to bounce!!! This is simply UNFAIR and needs to be exposed and STOPPED! Chase is ripping people off by slapping these outrageous NSF fees on people so that they can profit! For example, I had several small pending transaction amts, e.g., $17 from The Dollar Store, and $12.27 which Chase hit with a $35 NSF fee perspectively!!! COME ON!! They are ripping us off! They must be stopped! What can we do y’all? I’m fed up! I’m not going to even go into the other case I have brewing against Chase concerning their fees being charged on my son’s custodial acct since 2004! I’m in the process of going into my local Branch with my records from 2004 and showing them the proof of all these monthly service fees they’ve been ERRONEOUSLY charging to my son’s acct! I’m demanding that they reimburse my son’s acct with all Service fees retro to 2004 when they starterd deducting them!

Really, it doesn’t matter what order the bank debits your transactions in. If you have a $100 balance in your account and you make 5 debits that total $101, you overdrew your account. The simple and responsible solution would be to keep a check register and know exactly how much you have in your account. If you never overdrew your account, you’d never have this problem.

Thanks for your response cybercjh. But Chase (and any other bank for that matter) needs to be challenged on their NSF policies irregardless. I am sensible and responsible and do keep a check register, and print outs of my accts, monthly statements, etc. to make sure that I have HAD the money in the acct to cover debts and still Chase finds a way (as you and so many others in this post already know) to slap NSF fees on you. I’m writing my government authorities and Chase “big hogs”, re this practice. It’s not fair and it can’t continued to be tolerated by the public! In the meantime, my sensibility and responsibility is the reason why I’m addressing the other matter I wrote about in my post re Chase’s erroneous withdrawing of Service Fees from my son’s custodian acct since 2004! I’ve caught some of these charges over the past year and made them put the money back and they did! And now after researching my records, I’ve discovered that they’ve actually been sneaking these Services fees from my acct since 2004! Shame on me, huh? Not so.

Chase employees have appeared to be very rude and greedy to me. They just aren’t human! All they care about is getting every last dollar they can from you. Even if you try to deposit what they subtract from your account, they will just make up some extra charge, to laugh in your face about. It took us a total of two months just to close our account. People who had banked with Washington Mutual left in droves, and I wish I would have gotten out a lot sooner than I did, it’s been a nightmare. In my opinion, Chase Bank is a thief of highest proportions.

I’ll keep this short. Here’s my screwed by Chase bank story. Got a credit card from them when I was young and dumb. The *original* balance of the debt was just under $800. The debt is now over $5000 from fees/interests/bullshit lawyer fees. I thought they had already sued me once over the debt and charged it off but apparently not. I’m now being contacted by another lawyer threatening a lawsuit from them claiming it’ll go up to 7 or 8 grand. The lady was demanding a payment arrangement of at least 100 a month. I told her I could do 20. she said it was unacceptable so I said well i’ll have to call you back after I call my lawyer.

This might be a new one so heres a warning. I recieved my e-bill from chase for a payment due on Jan 16th, problem is I recieved it on Jan 19th, 3 days after the due date. For this I get charged a $39 late fee and get to wait for the notice of my rate going to %39 or whatever they think they can get away with. I contacted chase about it and there answer was they could waive the charge but they are not going to.I am contacting tort litigation attorneys to inquire about existing suit or the possability of starting a new suit.

I have been with chase bank for almost 3 years and they have been charging me overdraft fees and late fees of 35.00 and 12.00 last 3 years. chase refused to waived the overdraft fees. I have been charged over $3,400 in overdraft fees.

Were the overdraft fees because you really didn’t have money in your account to cover your purchases and the late fees because you didn’t pay by the due date … or did Chase just arbitrarily charge you fees because they felt like it?
